Розвиток земельних відносин в умовах формування ринкового обігу земель сільськогосподарського призначення

Abstract

Дипломну роботу присвячено обґрунтуванню теоретичних та методологічних основ, теоретичних положень та розробці науково- практичних рекомендацій, що спрямовані на вдосконалення заходів, інструментів та механізмів регулювання ринку земель сільськогосподарського призначення в Україні. Земля є своєрідним товаром у ринкових відносинах. Властивості та характеристики землі визначаються в дослідженні підходів як історичного змісту, так і сучасності. Це можна розглянути в законодавстві багатьох зарубіжних країн, де здійснюються відносини купівлі-продажу чи оренди землі. Виникла необхідність урахування європейської та світової практики правового регулювання ринку землі, оскільки в нашій державі сьогодні спостерігається недостатня розвиненість правових основ обігу земель, недосконалість усієї сучасної системи законодавства, яке регулює ці відносини, що є фактором, що стримує розвиток ринку землі в цілому. The thesis is devoted to the substantiation of theoretical and methodological foundations, theoretical provisions and the development of scientific and practical recommendations aimed at improving measures, tools and mechanisms for regulating the market of agricultural land in Ukraine. Land is a kind of commodity in market relations. Properties and characteristics of the land are determined in the study of approaches of both historical content and modernity. This can be considered in the legislation of many foreign countries, where relations of purchase and sale or lease of land are carried out. There was a need to take into account the European and world practice of legal regulation of the land market, since in our country today there is an insufficient development of the legal foundations of land circulation, the imperfection of the entire modern system of legislation that regulates these relations, which is a factor restraining the development of the land market as a whole.
